Sarkis Cafe owner sues brother over new Highland Park diner

The owner of Evanston’s Sarkis Cafe is suing her brother over his plans to open a Highland Park diner, saying he is “misleading” the public by claiming an association with Sarkis. The Chicago Tribune reports:

Scott Jaffe spent about a decade as the manager of the Evanston cafe, the suit states. But now that Jaffe plans next year to open his own restaurant, Order Up Diner, in downtown Highland Park, his sister Marla Cramin claims in the lawsuit that he has “misled and (is) likely to continue to mislead prospective consumers as to an affiliation, connection or association” with Sarkis.

The suit seeks to require Order Up Diner to state in its promotions that it has no affiliation with Sarkis and to pay Sarkis any profits gleaned from the new diner’s claimed misrepresentation. A hearing seeking a temporary injunction is scheduled for Wednesday.

In an interview, Cramin asserts her brother is “trying to leverage my name and goodwill.”

“I’m OK with him opening a restaurant,” Cramin said. “He just can’t open a Sarkis.”
